We, Fish Marblehead LLc, certify that we hold a valid Captain’s License issued by the U.S. Coast Guard and are authorized to conduct inshore and offshore fishing charters. We commit to taking all necessary precautions to avoid unnecessary risks and will do our utmost to steer clear of adverse weather conditions. Our aim is to ensure your fishing experience is both enjoyable and safe.
By hiring Fish Marblehead LLc, for a charter trip, We acknowledge that we will be boarding a fishing vessel in coastal waters. We understand our responsibility to prioritize our own safety and agree to do so. We recognize and accept the risks and hazards inherent in this activity, which include, but are not limited to:
- Varied weather conditions (sun, rain, lightning, etc.)
- Seasickness
- Vessel movement (pitching and rolling)
- Dehydration or lack of nutrition
- Slippery decks
Potential injuries, both internal and external, from activities such as boarding the vessel, handling fish, using fishing gear, or due to the actions of others on board.
We assume all risks associated with participating in these activities. We understand that liability may arise from negligence or carelessness of others, equipment defects, or other factors, and We hereby waive, release, and discharge Fish Marblehead LLc, and its crew from any and all claims related to my death, disability, personal injury, property damage, theft, or any future incidents.
We agree to indemnify and hold harmless the Captain, crew, and Fish Marblehead LLc from any claims made by other parties resulting from my actions during the trip.
We understand that the Captain and crew of Fish Marblehead LLC, are not liable for any risks associated with inshore and offshore fishing, and We release them from liability for any related incidents.
We acknowledge that fishing is not advisable for individuals with pre-existing medical conditions, such as circulatory issues, high blood pressure, heart conditions, pregnancy, or brittle bones. The vessel has limited medical facilities, and any required medical assistance will be delayed until transportation to an appropriate facility can be arranged. We understand that the Captain and crew are not medical professionals and in the event an issue that arises that needs medical attention, they will, to the best of their ability, provide first aid to passengers until professional help can arrive on scene.. We agree to hold them harmless for any actions taken in those situations.
We release the Captain, crew, Fish Marblehead LLC, its employees, agents, owners, and affiliates from any liability for injuries or damages. We agree not to file any claims against the aforementioned parties for injuries or damages arising from negligence, including gross negligence. We also agree to indemnify and hold harmless the released parties for any causes of action resulting from incidents that may occur during my participation.
We understand that this Accident Waiver and Release of Liability is intended to provide the broadest release permissible under applicable law. By signing, We confirm that I have read, understood, and agree to the terms of this document.
